Source Texts: Married Women's Head Coverings

This is something of a  blank source sheet, with a listing of the different source texts that I discuss on this blog.  Hopefully it will be of help to anyone putting together materials on the topic.  This sheet will have Jewish texts.  Another may follow with general quotations that might be of interest or use, to make them available in one place.

וְהֶעֱמִיד הַכֹּהֵן אֶת-הָאִשָּׁה, לִפְנֵי יְהוָה, וּפָרַע אֶת-רֹאשׁ הָאִשָּׁה, וְנָתַן עַל-כַּפֶּיהָ אֵת מִנְחַת הַזִּכָּרוֹן מִנְחַת קְנָאֹת הִוא; וּבְיַד
.הַכֹּהֵן יִהְיוּ, מֵי הַמָּרִים הַמְאָרְרִים

And the priest will stand the woman before God, and he will [wait on this one] the head of the woman, and put on her hands the memorial meal offering, which is a meal offering of jealousy, and in the hand of the priest will be the bitter waters that induce the spell.  (Based on NJPS translation)

Baba Kama, chapter 8, mishnah 6:

Ketubot72a-b, excerpts:

מתני': ואלו יוצאות שלא בכתובה. העוברת על דת משה ויהודית. ואיזו היא דת משה? מאכילתו שאינו מעושר, ומשמשתו נדה, ולא קוצה לה חלה, ונודרת ואינה מקיימת. ואיזוהי דת יהודית? יוצאה וראשה פרוע, וטווה בשוק, ומדברת עם כל אדם. אבא שאול אומר: אף המקללת יולדיו בפניו. רבי טרפון אומר: אף הקולנית. ואיזוהי קולנית? לכשהיא מדברת בתוך ביתה ושכיניה שומעין קולה.
And these are the women who leave [can be divorced] without a ketubah: One who transgresses against the law of Moses or [the law of] Yehudit/Jewish women.  And what is the law of Moses?  She feeds him [her husband] [food that] isn’t tithed, or who has sex with him while she is in Niddah, or who doesn’t take challah, or who makes a vow and doesn’t fulfill it.  And what is the law of Yehudit?  One who goes out with her head uncovered/wild, or who spins in the marketplace, or who speaks with all men.  Aba Shaul says: even one who curses his parents in his presence.  Rabbi Tarfon says: Even the Kolanit.  And what is a Kolanit?  When she speaks within her house, her neighbors hear her voice.
ואיזוהי דת יהודית? יוצאה וראשה פרוע:
ראשה פרוע דאורייתא היא, דכתיב (במדבר ה, יח) ופרע את ראש האשה. ותנא דבי רבי ישמעאל: אזהרה לבנות ישראל שלא יצאו בפרוע ראש. דאורייתא- קלתה שפיר דמי, דת יהודית- אפילו קלתה נמי אסור. אמר רבי אסי אמר ר' יוחנן: קלתה אין בה משום פרוע ראש הוי בה רבי זירא. היכא? אילימא בשוק- דת יהודית היא, ואלא בחצר אם כן, לא הנחת בת לאברהם אבינו שיושבת תחת בעלה. אמר אביי, ואיתימא רב כהנא- מחצר לחצר ודרך מבוי:

And what is the law of Yehudit?  One who goes out with her head uncovered/undone.  An uncovered/wild head is a Biblical prohibition! As it says (Numbers 5:18): and he uncovers/musses the woman’s head.  And the house of Rabbi Yishmael teaches: [this pasuk is] a warning to the daughters of Israel, that they should not go out with their head uncovered/wild.  Biblically, a basket is also permissible [as a head covering], according to the law of Yehudit, a basket is also forbidden.  Rabbi Asi says in the name of Rabbi Yochanan: wearing a basket is not considered to be an uncovered head.  Rabbi Zeira spoke about this statement [of Rabbi Yochanan].  Where [is he talking about]?  If you say in the marketplace- this is a matter of the law of Yehudit! Rather, would you say in the courtyard?!  If so, you haven’t left a single daughter of Abraham our father who can remain married!  Abaye said, and some people say Rav Kahana said, [the situation is] from one courtyard to another, by way of an alley.  

Rashi on Ketubot 72a:

קלתא: סל שיש לו בית קבול להולמו בראשו ובית קבול מלמעלה לתת בו פלך ופשתן.

Kalta: a basket that has an indentation to attach closely to the head, and an indentation above to put a spindle and linen.

Yoma 47a:

אמרו עליו על רבי ישמעאל בן קמחית פעם אחת סיפר דברים עם ערבי אחד בשוק ונתזה צינורא מפיו על בגדיו ונכנס ישבב אחיו ושמש תחתיו וראתה אמן שני כהנים גדולים ביום אחד ושוב אמרו עליו על רבי ישמעאל בן קמחית פעם אחת יצא וסיפר עם אדון אחד בשוק ונתזה צינורא מפיו על בגדיו ונכנס יוסף <עם> אחיו ושמש תחתיו וראתה אמן שני כהנים גדולים ביום אחד ת"ר שבעה בנים היו לה לקמחית וכולן שמשו בכהונה גדולה אמרו לה חכמים מה עשית שזכית לכך אמרה להם מימי לא ראו קורות ביתי קלעי שערי אמרו לה הרבה עשו כן ולא הועילו

It was told of R. Ishmael b. Kimchit that one day he spoke to an Arab in the marketplace, and spit from his mouth flew on his garments, and therefore his brother Jeshebab entered and served in his stead. Thus their mother saw two high priests on one day. Furthermore, it is said of R. Ishmael b. Kimchit that he went out and talked with a certain lord in the street, and spit from his mouth squirted on his garments, and therefore Joseph his brother entered and served in his stead so that their mother saw two high priests on one day.

Our Rabbis taught: Kimchit had 7 sons, and all of them served in the high priesthood.  The Sages said unto her: What did you do to merit (or deserve) this? She said: All the days of my life, the beams of my house have not seen the plaits of my hair. They said to her: There were many who did likewise and yet did not succeed.  

Halakha:

Shulhan Arukh, Even HaEzer 21:1

אסור לשמוע  קול ערוה או לראות שערה
 It is forbidden to listen to the voice of a sexually-forbidden-woman, or to look at her hair.

Shulhan Arukh, Even HaEzer 21:2

לא תלכנה בנות ישראל פרועות ראש בשוק, אחת פנויה ואחת אשת איש
The daughters of Israel should not walk with uncovered heads in the marketplace, both unmarried and married women

Bayit Hadash (Bakh), Even HaEzer 21

לא ילכו בנות ישראל פרועות ראש בשוק אחת פנויה ואחת אשת איש: נראה דנפקא לן מדאיתא פרק המדיר (כתובות עב.) ואיזהו דת יהודית?  יוצאה וראשה פרוע.  דאורייתא  היא דכתיב (במדבר ה יח) "ופרע [את] ראש האשה"!  ותנא דבי רבי ישמעאל אזהרה לבנות ישראל שלא יצאו בפרוע ראש
דמדלא קאמר אזהרה לאשת איש אלא סתמא אזהרה לבנות ישראל אלמא דאחת פנויה ואחת אשת איש באזהרה.  מיהו במרדכי כתב ס"פ [סוף פרק] מי שמתו (ברכות סי' פ) ע"ש  "[וכתב] ראבי"ה (סימן עו) וז"ל [וזה לשונו]: "כל הדברים שהאזהרה למעלה לערוה דוקא בדבר שאין רגילות להיגלות אבל בתולה הרגילה בגילוי שער לא חיישינן, דליכא הרהור" עכ"ל [עד כאן לשונו].
ואין לפרש דדוקא בבית ובחצר אבל בשוק אסורה לצאת  דהא ברפ"ב [ראש פרק 2] דכתובות (טו: ) שנינו אם יש עדים שיצאת בהינומא וראשה פרוע כתובתה מאתים ויצאת פירש"י [פירש רש"י] (ד"ה [דיבור המתחיל] אם יש עדים) מבית אביה לבית בעלה ואפי' [ואפילו] דרך השוק
משמע, וכן נהגו וצריך לומר דבפנויה בעולה קאמר, אבל הבתולות אינן באזהרה.

The daughters of Israel do not go with an uncovered head in the marketplace,  both an unmarried and a married woman: It seems to originate in what it says in Ketubot chapter “” (daf 72a): “What is Dat Yehudit?  She goes out with an uncovered head.  But that is from the Torah, as it says (Numbers 5:18) ‘And he uncovers the head of the woman’ [context is the Sotah ritual, as explored in these posts].  The house of Rabbi Ishmael says, a warning to the daughters of Israel that they should not go out with an uncovered head.”
Since it does not say “a warning to a married woman”, but rather simply “a warning to the daughters of Israel”, both unmarried and married women are included in the warning.  However, in the Mordechai, at the end of Brachot, chapter “One Whose Dead”, section 80, it says “the Ra’avya writes: ‘All the matters in the warning about is specifically about erva [nakedness], in a matter that they do not usually reveal, but we are not concerned about a virgin, who is accustomed to revealing her hair, because there is no [concern over] improper fantasy.”
And one should not explain that this [that a virgin goes with an uncovered head] is specifically in the house or courtyard, but [her going with an uncovered head] is still forbidden in the marketplace, because at the beginning of the second chapter of Ketubot (15b) it says that if there are witnesses that a woman went out in a hinuma, and her head is uncovered, her ketubah is 200.  [Going out in only a hinuma is sufficient legal evidence that she was a virgin when she married, and therefore gets the higher ketubah value.  This implies that unmarried virgins do not cover their hair, even in public.  For some more about the ambiguous meaning of the term hinuma, see this post]  Also, Rashi explains (in his comment beginning: If there are witnesses) that this means when she goes from her father’s house to her husband’s house, even by way of the marketplace.  This is our custom, and therefore it is necessary to say that the Tur meant a non-virgin unmarried woman [when he said that unmarried women also cover their heads], but virgins are not included in the warning [from the house of Rabbi Ishmael, in Ketubot 72a.]

אחת פנויה ואחת אשת איש: פנויה בעולה קאמר, אבל בתולה אמרינן דיוצאה בהינומא וראשה פרועה, וכן הוא בב"ח ועיין במרדכי
Both an unmarried and a married woman (the citation from Shulhan Arukh): this means an unmarried woman who has had sex, but we say that a virgin may go out with only a hinuma and an uncovered head, and thus in the Bach, and see the Mordecai.  

Beit Shmuel on Shulhan Arukh E"H 21:2

 אחת פנויה: היינו אלמנה או גרושה אבל בתולה מותר ופריעת הראש בחצר ליכא אסור אלא
משום צניעות ועיין ב"י וד"מ בסי' קט"ו ושם כתבתי בשם הסמ"ג והש"ג דאסור אפילו בחצר
And also unmarried: This is a widow or a divorcee, but a virgin is permitted, and to go with an uncovered head in a courtyard is not forbidden except because of modesty...

Yalkut Yosef

אשה נשואה חייבת על פי הדין לכסות את ראשה, ואין לה לצאת לרה"ר כששערה מגולה. ועל פי הדין מותר לאשה נשואה לילך בביתה בגילוי ראש (כשאין שם אנשים זרים), אבל ראוי מאד לנהוג שלא לילך גם בבית בגילוי ראש.    [אוצר דינים מהדו"ק עמוד שנט

ט פשט המנהג שבנות רווקות הולכות בגילוי ראש ברשות הרבים, שמעיקר ההלכה אשה שאינה נשואה אינה חייבת בכיסוי ראש. ורק בעת שמתפללות או מברכות ומזכירות שם שמים, תכסנה ראשן. [אוצר דינים מהדו"ק עמוד שסא. יביע אומר ח"ד אהע"ז סי' ג'. וחלק ה' סימן ה אות ב]

8. A married woman is obligated by law to cover her head, and she should not go out into the public domain with her hair uncovered.  According to law, it is permitted for a married woman to walk in her house with an uncovered head (when there are no unrelated men present), but it is very appropriate to also not go about with an uncovered head at home as well.  

9. The tradition spread that unmarried girls go with an uncovered head in the public domain, as from the essence of the law, an unmarried woman is not obligated in head-covering.  And only at the time when they pray or make brachot or say the name of God, they should cover their head.
